Terms and conditions regulate inter alia the terms of delivery and merchandise refunds/exchanges/payments and lay-buys between you, the customer and us Value Lounge. By signing below, you, the customer agree to the terms and conditions.
1.OWNERSHIP Until such time as payment is made in full for the merchandise, ownership thereof rests with Value Lounge.
2.DELIVERY COMMITMENT
Where Value Lounge is responsible for delivery, then an arrangement will be made with the customer for the date and time of the delivery at the time of sale. If the delivery date and time cannot be met due to unforeseen circumstances, then the customer will be contacted immediately so as to make alternative arrangements.
3.CANCELLATIONS OF ORDERS NOT YET DELIVERED.
All orders cancelled prior to delivery ,will be subjected to a 15% handling fee for relevant bank charges.
4.DELIVERIES /COLLECTIONS /STORAGE
No deliveries /collections will take place until full payment has been received. Normal deliveries by Value Lounge will also take place within pre-designated areas and during office hours between Mondays to Saturday. For all other deliveries, please contact the Manager.Value Lounge will only make deliveries where the merchandise can fit in lifts, staircases or through doors and merchandise will not be hoisted onto balconies. Please ensure that the place of delivery is accessible for deliveries, the space cleared for the merchandise prior to delivery and that all breakables have been removed that might be in the way. Any additional delivery costs due to failed deliveries as a direct result of, access problems and/or customers not available at time of delivery will be for the customer’s account. Should a customer require that Value lounge store merchandise on their behalf and at their own risk, then please contact the store manager for Value Lounges rates and conditions.
5.PROOF OF DELIVERY & DAMAGE TO DELIVERED MERCHANDISE :
A signed Proof of Delivery by you or a representative, is proof that you have received the merchandise in good condition and undamaged. If there is any damage to the merchandise this must be annotated/recorded on the Proof of Delivery upon delivery and reported by you in writing to the Store Manager within 24 hours of delivery. Refer to clause 8 below regarding exchanges /refunds.
6.COLLECTIONS:
Appointments for collections and delivery from Value Lounge warehouse must be 2 working days advance. Please advise the contact person in –store at the time of purchase /after purchase, as to who will be collecting the merchandise together with the date and time of collection. The person collecting the merchandise, must produce an Original Order Confirmation (to which these terms and conditions are attached) as well as the original proof of purchase for the merchandise to be released. Upon release of merchandise, if no damage to thereto is recorded on the collection docket, it will assumed that the merchandise was received in perfect condition. If after 14 days from the purchase date ,the merchandise is not collected , Value Lounge reserves the right to charge a fixed storage fee per month for up to three months and there after retain ownership of the merchandise and reserves the right to sell it to defray expenses.
7.LAY-BUYS /SPECIAL ORDERS
Lay-buys can only be on products that are not marked down or on special, a 30% deposit is also required for all lay-buys and maximum pay off period is 3 months ( 3 instalments). Any lay-buys not paid up over this period will be put back on the floor to be sold and all refunds for lay-buy deposit will subject to a 10% handling fee.All special orders require 50% deposit and no order will be processed until the deposit has been paid. If an order is cancelled within 7 days of having paid the 50% deposit, 10 % of the deposit will be forfeited as a handling fee. All special orders cancelled after this period will forfeit the full 50% deposit.
8.REFUNDS/EXCHANGES POLICY
Merchandise that is delivered damaged will only be refunded or exchanged and credit given if there is compliance with requirements in clause 5 and 5. For special orders , refer to clause 7 above. There will be no refunds/exchanges on sales, marked –down or shop-soiled merchandise. Apart from the above mentioned and the provisions of clause 5, 6, 7, 10 and 12, we will only accept returned merchandise that is returned within 5 days of purchase provided that (1) the merchandise is in perfect and unused condition and (2) proof of purchase is provided.Any balance to be refunded will be buy credit notes that will valid for 6 months.
9.DEPOSIT,CHEQUES AND BANK TRANSFERES
Cash deposit by the customer must be faxed or emailed to the Value Lounge store and the store must also be notified by the customer that the deposit has been made and to confirm the store received a copy of the deposit. Merchandise will only be released once full payment reflects in Value Lounges account.Cheque deposit (cash cheque and bank guaranteed cheques) will require 7 working days for the bank to clear. Merchandise will only be released two days after the cheque is cleared.
10.MERCHANDISE ASSEMBLY
Value Lounge will assemble all merchandise that needs assembly, before or during the delivery off such products. If a customer however does not want assembly at any time of delivery or pick up , then Value Lounge will not be liable for any damage to merchandise or liable to injury. No refunds /exchanges will be entertained for merchandise that has been assembled by the customer or his /her representatives.
11.MERCHADISE WARRANTIES- SUPPLY WARRANTIES For merchandise warranties, please refer to suppliers guarantee / warrantee booklet supplied with the product or enquire in store. No other warranties, representations or guarantees apply in respect of the merchandise. Kindly consult the store staff for information on how best to care for your merchandise. In this regard, please note that leather and timber merchandise may have natural markings and colour variations due to the nature of the product and these are enhancements of the natural product making up the merchandise and not defects/ signs of damages. All claims are subject to assessment by our trained staff and decisions made at the discretion of the Store Manager.
12.Please note that we will not be liable for any damage whatsoever whether direct or consequential arising out of the use of merchandise or in respect of delivery.
13.Vale lounge and its suppliers has the option to first repair then replace as per the agreement with the relevant suppliers.
14.Clients warrants that goods are used for the purposes it was made for and that it is within their financial constraints.
15.Value lounge reserves all rights herein.
